Seminar

What is the Point of Justification?

27 May 2024 | NOVA School of Law

The seminar “What is the Point of Justification?” will take place between 2pm and 4pm in the Sala do Conselho Científico at NOVA School of Law.

Speaker

James Edwards, University of Oxford

Abstract

Imagine D performs an action that is a criminal offence. D is justified in performing that action, some say, if and only if two conditions are verified: first, there must be an undefeated normative reason for D to so act; second, D’s motivating reason for so acting must match that normative reason. Call this the “matching reasons thesis” (MRT). Proponents of MRT defend it by appealing to the point of justification. I argue that, if proponents are right about why justification matters, we lack reason to endorse either limb of MRT: we lack reason to accept either that matching reasons are necessary for justification or that they are sufficient.
